USE BY CHILDREN

The Site is intended to be accessible and read by general audiences but INSPIRE does not solicit, offer or sell any donations, products or services, through this Site to children under the age of 13.

ACCOUNTS

Some INSPIRE sites and services permit or require you to create an account to participate or to secure additional benefits. You agree to provide and maintain accurate, current and complete information, including your contact information for notices and other communications from us and your payment information. You agree not to impersonate or misrepresent your affiliation with any person or entity, including using another person’s username, password or other account information, or another person’s name or likeness, or provide false details for a parent or guardian. You agree that INSPIRE may take steps to verify the accuracy of information you provide, including contact information for a parent or guardian.

You agree to promptly notify INSPIRE of any unauthorized use of your username, password or other account information, or of any other breach of security that you become aware of involving your account or the applicable INSPIRE service.

PAID TRANSACTIONS

INSPIRE processes many transactions through the Site, including for (i) donations; (ii) tickets for participation to INSPIRE events, and may include (iv) other online transactions that generate shipment of goods. Paid transactions are processed by INSPIRE, or a third party if one is identified at the time the transaction is processed. Third party transaction processors may apply different or additional terms and conditions, which you should read when they are presented to you.

You will have the opportunity to review and confirm your transaction details, including delivery address (if applicable), payment method and items purchased. A receipt will be emailed to you after your transaction is processed. At such time, the paid transaction is complete and binding.

DONATIONS

Donations processed through the Site are non-refundable. If you have made a donation through the Site and believe there has been an error, or you become aware of an unauthorized donation transaction, please contact us at info@inspirelifeskills.org as soon as possible. INSPIRE will refund donations only in the event of a mistake or unauthorized transaction, or due to identity theft or other extreme circumstances where a reasonable and satisfactory explanation is provided. INSPIRE may ask for proof of identity before issuing a refund. In the event that INSPIRE determines that a refund is warranted, the refund will be processed using the original method of payment. If a refund request is not made promptly after a transaction has been completed, it may not be possible for INSPIRE to issue a refund, due to tax laws and other reasons.

EVENT TICKETS & PURCHASES

All ticket purchases for admission to INSPIRE events are final. There are no refunds, or cancellations. Please contact info@inspirelifeskills.org if you have any questions.

EXCESSIVE DATA USAGE CHARGES

Accessing and using the Site on your mobile device will require use of your data service. Depending on the plan you have with your mobile network carrier, you could incur excessive data charges. You should check with your mobile network carrier and determine how you will be charged for data usage. INSPIRE is not responsible for your data usage and will not be responsible for excessive data charges that you may incur. You are responsible for any Internet connection, data or other fees assessed by your mobile network carrier to access the Site via your wireless device, including any data plan charges, toll, out-of-area, roaming or other wireless device connection charges.

SEVERABILITY AND NONWAIVER

If any provision of these Terms of Use shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. The failure of INSPIRE to insist upon or enforce strict performance of any of the provisions of these Terms of Use or to exercise any rights or remedies under these Terms of Use will not be construed as a waiver or relinquishment to any extent of INSPIRE’s right to assert or rely upon any such provisions, rights or remedies in that or any other instance; rather, the same will be and remain in full force and effect.

APPLICABLE LAW AND JURISDICTION

These Terms of Use and any amendments or revisions shall be governed by applicable federal law and the laws of the State of California, without regard to its conflict of laws principles. Any case, controversy, suit, action, or proceeding arising out of, in connection with, or related to these Terms of Use or the use of the Site shall be brought in the federal judicial district in the County of Riverside, and you irrevocably consent to personal jurisdiction in the state or federal courts located in the State of California.

LIMITATION ON TIME TO FILE CLAIMS

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE SITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

USE OF THE SITE OUTSIDE THE UNITED STATES

The Site is controlled and offered by INSPIRE from the United States. INSPIRE makes no representations that the Site is appropriate or available for use in other locations. If you access the Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

If you are located outside of the United States, the information you provide to us will be transferred to the United States and that by providing your Information, you consent to this transfer and storage of the data in the United States.

TERMINATION

Notwithstanding any of these Terms of Use, INSPIRE reserves the right, without notice and in its sole discretion, to terminate your use of the Site and to block or prevent future access to and use of the Site.

DATA RETENTION

INSPIRE may maintain backups of data including registration data to recover data and restore accounts in case of errors or system failure. Therefore, data that you delete or that INSPIRE deletes may remain backed up. INSPIRE does not guarantee that backups will function error-free. INSPIRE may not be able to restore data from a backup on request. For these reasons, you are responsible for maintaining your own backups.

SWEEPSTAKES & CONTESTS

INSPIRE may operate sweepstakes, contests, and similar promotions (collectively “Promotions”) through this Site. You should carefully review the rules (“Official Rules”) of each Promotion in which you participate, as the Official Rules may contain additional terms and conditions. In the event the Official Rules conflict with this Terms of Use, the Official Rules will control.
